Aliento Responds to Lawsuit Challenging Prop. 308
Phoenix, AZ (August 27, 2026) - Today, the U.S. Department of Justice (DOJ) filed a lawsuit challenging Arizona’s law that provides in-state tuition to Dreamers.
Aliento strongly opposes this lawsuit. The DOJ is attempting to stop Dreamers from accessing Arizona’s public colleges and universities. We want to make it clear that this lawsuit is not a new law, and it has not been implemented. Arizona’s in-state tuition law, which was implemented in 2022, remains in effect. Dreamers can still enroll in and attend Arizona public colleges and universities under the current law and pay in-state tuition.
In 2022, Aliento worked alongside students, families, and community partners to pass Proposition 308. Thanks to voter approval, Prop. 308 allows eligible students who attended and graduated from an Arizona high school, or met equivalent requirements, to qualify for in-state tuition and state financial aid regardless of their immigration status.
“The DOJ is trying to do everything they can to stop Dreamers from attending college. The Arizona in-state tuition law that is voter-protected and is consistent with state and federal law. I have no doubt that the DOJ will lose this battle in the courts,” said Reyna Montoya, Aliento’s Founder and CEO. “For Arizona Dreamers, it is important to know that you belong in higher education and that you have the support of Arizona voters and Aliento. A lawsuit does not change Dreamers' ability to pay in-state tuition. This can be confusing, but I encourage you all to keep going and get your education."
